Custodio ‘not nuisance candidate’ – Comelec

TAYUG- The Second Division of the Commission on Elections (Comelec) has decided with finality that 6th District congressional candidate Myrna Paraguas-Custodio is not a nuisance candidate for the May 13 elections.

In a five-page decision obtained by Northern Watch which was promulgated on March 18, 2019, Comelec ruled that the petition of Tayug Mayor Tyrone Agabas was denied and dismissed.

Agabas and Paraguas-Custodio are rivals for the congressional seat.

It can be recalled that on October 22, 2018, Agabas sought to declare Custodio as a “nuisance candidate” alleging that “she has no bona fide intention to run for the congressional seat in the District.”

            On November 19, 2018, responding on the petition, Custodio said that she has met all the qualifications to run for the congressional position, she being an active politician for years and a businesswoman by profession.

Comelec, in its decision, found no merit on the petition of Agabas citing Section 60 of the Omnibus Election Code (OEC).

Comelec has likewise ruled that it “recognizes the right of people to seek elective office, nevertheless, it is still subject to some limitations as the Supreme Court in Pamatong vs. Commision on Elections held “xxx the privilege of equal access to opportunities to public office may subjected to limitations. Some valid limitations specifically in the privilege to seek elective office are found in the provisions of Omnibus Election Code on “Nuisance Candidates”xxxx.”
