CORTEZ: Bakit hindi na kailangan ang Commission on Human Rights?

TULOY ANG KASO KAY PNOY.Tuloy ang laban ni PNoy sa kasong isasampa na sa Sandiganbayan ng Ombudsman. Malinaw daw po na nagkasala si PNoy.
 
Sabi ng Ombudsman na “clearly the Office found probable cause against President Aquino not simply for having assented to, or at the very least failed to prevent Purisima from committing a violation of Article 177 and Section 3(a) of R.A. No. 3019, but actually for having utilized the services of Purisima for Oplan Exodus while the latter was under preventive suspension, thus, President Aquino’s complicity and influence in the commission of said offenses.” 
 
Narito pa po ang sabi ng Ombudsman: “while a President of the Republic is certainly possessed with broad discretionary powers, the exercise thereof must not, however, be done in violation of a law or laws, much less when such exercise constitutes a crime.  Every public official and office is expected under the law to fully comply with it, without any form of circumvention, run-around, equivocation or pretense. Obedience to the rule of law forms the bedrock of our system of justice.  A government of laws, not of men, excludes the exercise of broad discretionary powers by those acting under its authority.” 
 
AFFIRMED NG OFFICE OF THE Ombudsman ang kaso laban kay PNoy sa isyu ng Oplan Exodus kung saan 44 na SAF officers ang napatay at ilang mga sibilyan ang nadamay.
 
The Ombudsman stated that “President Aquino’s act of utilizing the services of the preventively suspended [Alan] Purisima for Oplan Exodus prior to and during its implementation, despite an OIC PNP Chief having been already designated, caused Purisima to perform under pretense of official position, the acts pertaining to the PNP Chief without being lawfully entitled to do so, in violation of Article 177 of the RPC on Usurpation of Official Functions.”  It added that “President Aquino’s act of utilizing the services of Purisima for Oplan Exodus under the aforesaid circumstances constituted an act of persuading, inducing or influencing another public officer to perform acts constituting a violation of the order of preventive suspension and a commission of usurpation of official functions in violation of Section 3(a) of R.A. No. 3019.”
 
Bakit kay suspended PNP Chief Purisima inatas ang Oplan Exodus kahit may designated OIC PNP Chief na?
 
Ang pag gamit ni PNoy kay suspended PNP Chief Purisima ay mali daw po dahil nga under preventive suspension yung tao.
 
Ang pag ganap naman ni suspenden PNP Chief Purisima sa Oplan Exodus ay ususrpation ng official function ng OIC PNP Chief.
 
Reckless imprudence, criminal negligence, usurpation of official functions, at graft ang hinaharap ni PNoy.

 
“any negligence during the planning, preparation and actual implementation of Oplan Exodus was subsequently broken by the occurrence of an efficient intervening cause,” which was the intentional act of shooting by the hostile forces.  The Ombudsman added that “on certain points of law concerning the quasi-offense of reckless imprudence, the careless act is single whether the injurious result affects one person or several persons, and criminal negligence remains one and the same and cannot be split into different crimes and prosecutions.” In other words, in an instance of reckless imprudence resulting in multiple homicide, only one count of Information may be filed against an accused regardless of the number of deaths involved, and only one penalty is imposed, not as many counts as the number of deaths
 
Ang penalty sa kasong reckless imprudence resulting in multiple homicide is only four months and one day to four years and two months in prison.
 
Pero ang penalty naman sa kasong Usurpation of Official Functions carries the penalty of six months and one day to four years and two months in prison.
Habang ang kaso naman ng graft kay PNoy ay may penalty of imprisonment of six years and one month to fifteen years in prison.
 
MAGSUSUMBONG KA BASA CHR? How many ba sa inyo ang sa Commission on Human Rights nagsasampa ng kaso kapag may human rights violation?
 
How many generals na ba ang naipakulong ng Commission on Human Rights?
 
Kung masyadong mataas ang heneral… How many sargeants na ba ang naipakulong ng Commission on Human Rights?
 
Ang Commission on Human Rights ay naimbento sa loob ng Cory Constitution noong 1987.
 
Nagkaroon ng takot ang mamamayan sa pulis at sundalo dahil sa panahon ng Martila Law ay sila ang nagpatupad ng batas.
 
Dahil ang pulis at sundalo ay nagamit sa personal na interes ng may kapangyarihan, sila ay nakagawa ng mga labag sa batas.
 
Ang kanilang mga paglabag sa batas at tinawag na human rights abuses.
 
Dahil may human rights abuses na ginawa ang pulis at sundalo ay naisipan ng mga gumagawa ng constitution na magtayo ng Commission on Human Rights.
 
Kung tututusin ang Commission on Human Rights ay itinayo bilang bantay laban sa pagmamalabis ng pulis at sundalo.
 
Pero, may sariling investigating body ang pulis at sundalo, tulad ng Internal Affairs Service.
 
May court martial pa nga ang sundalo kung mya nakagawa ng krimen.
 
Siyempre nadiyan ang mga regular courts kung gusto niyong kasuhan  ang sundalo at pulis.
 
 
May mga bayan dito sa Pangasinan na kung saan ay mababa ang number of court cases.
 
May mga bayan dito sa Pangasinan kung saan may mga gun-for-hire.
 
May mga tao dito sa Pangasinan na ang gusto ay ipatupad ang sariling criminal justice system.
 
Bakit? Dahil palpak angPhilippine criminal justice system.
 
Dahil palpak ang Philippine criminal justice system ay hindi na nagsasampa ng kaso ibanga tao kapag sila ay nagawan ng krimen.
 
Dahil palpak ang Philippine criminal justice system ay umuupa na lang ng gun-for-hire ang ibang tao na nagawan ng krimen ng ibang tao.
 
Dahil palpak ang criminal justice system ay nagsusumbong na lang sa NPA ang mga nakakaranas ng krimen.
 
Ang ibang mga nasa hanay ng pulis ay nagplano para maaresto ang isang kriminal o grupo ng mga kriminal.
 
Nahuhuli ang mga kriminal, pero may mga nasusugatan o kaya ay namamatay sa hanay ng pulis.
 
Nakukulong ang criminal pero mahabang taon bago masentensiyahan ang nahuli at naikulong na kriminal.
 
Kung minsan ang kriminal ay nakakalaya dahil may butas ng criminal justice system… ano kaya ang feeling ng mga pulis na humuli sa criminal?
 
May mga pulis na mas gusto nilang ‘nanlaban’ ang kanilang huli na kriminal para masentensiyahan na agad… as in patay agad.
 
Kapag ang isang Kian ay napatay ng pulis, ano ang tawag doon? Murder o homicide.
 
Ibig sabihin, puedeng kasuhan ng murder o homicide ang pulis na nakapatay sa isang Kian.
 
Hindi na kailangan ng isang Commission on Human Rights para makasuhan ang pulis.
 
Magsampa lang ng kaso ang mga magulang ni Kian sa korte ay gugulong na ang criminal justice system.
 
Kapag ang sundalo ay nakapatay ng sibilyan, ano ang tawag doon? Murder o homicide.
 
Ibig sabihin, puedeng kasuhan ng murder o homicide ang sundalo na nakapatay sa isang sibilyan.
 
Hindi na kailangan ng isang Commission on Human Rights para makasuhan ang sundalo.
 
Magsampa lang ng kaso ang mga magulang o kamag-anak ng sibilyan sa korte ay gugulong na ang criminal justice system.
