DENR order shows Laoac LGU  owns dairy farm land

LAOAC- The issue on who owns the property in barangay Maraboc where the Pangasinan Dairy Farm was established has long been resolved by the Department of Environment and Natural Resources (DENR).
 n order dated October 15, 2008 issued by  DENR Regional Technical Director Crizaldy M. Barcelona denied the application of one Ruby Esguerra over the property, as the lot in question has been granted to the the munipality of Laoac.
It was as early as September 13, 2006 that the property was granted to Laoac LGU, under then Mayor Antonio Abalos.
Esquerra claimed of ownership of the lot based on Tax Declaration No. 12457 dated April 27, 2007, or a year after it has been granted to the Laoac LGU.
The DENR cancelled the plan giving the property to Esguerra because of “fraud and misrepresentation,” after she submitted fradualent documents.
The DENR said the claimants submitted a certification from a certain Barangay Captain Ricardo Retuta of Maraboc village. However, upon verification the real name of the Barangay captain was Eduardo Retuta, making the submitted document spurious.
 A certification from a Barangay Captain is one of the requirements for the issuance of a survey authority certifying that the survey claimant is the owner of the land sought to be surveyed.
 The order further said that ” this office has been defrauded by survey claimant Ruby Esquerra, et al, in the same manner as the petitioner ( municipality of Laoac, supplied) has been defrauded leading to the approval of the said survey plan.”

The order also said that ” the certification submitted by survey claimant Esquerra, et al, is clearly tainted with fraud and misrepresentation, and should be treated as a mere piece of paper without any legal effect.”
 It could be recalled that last February, the Save Pangasinan Movement staged a rally at the Pangasinan Dairy Farm site in Maraboc village and one of its issues was the “ownership of the land” where the farm was constructed.
 A certain Divina Mangonon, one of the claimants with Esguerra’s group, said her her family has not yet been paid.  The order however, showed that their claim has been denied eigth years ago.
