Comelec dismisses disqualification case vs Bataoil

By Yolanda Sotelo

DAGUPAN CITY – The Commission on Elections has dismissed “outright” the disqualification case for alleged vote buying filed against Pangasinan Second District Rep. Leopoldo Bataoil, because the Commission “has no more jurisdiction over him in the light of his proclamation and assumption of office as elected member of the House of Representatives.”
The Comelec also dismissed the case against his brother, Lingayen Councilor Ramon Bataoil, who also was re-elected in the elections last May 13, for lack of substantial evidence.
In a resolution dated August 29 but a copy was given to this paper only on September 23, the Comelec said the complainant, one Richard Beil Ortega of Binmaley, Pangasinan, withdrew the case saying he was no longer interested in pursuing the disqualification and the criminal complaints against the brothers. The summit discussed the possibility of an economic zone in the province.
A BIR official, based in Region 1 but who asked anonymity, opined that the presence of the economic zones in Pangasinan will diminish the tax collection of the agency because of the five percent flat rate given as incentives to foreign and local investors inside the zone.
“Pag sa loob ka ng export processing zone uniform ang tax five percent. Example , garments 5 %. Pag sa labas ka may income tax, merong VAT (valued added tax), percentage tax, etcetera pag sa loob ka mababa ang babayaran mo. Uniform five percent international (investor), five percent local investor. So maliit lang makukuha ng BIR,” the official said. (more…)
