Compromise between Labrador and Transco

LABRADOR – Provincial Legal Officer Atty. Geraldine Baniqued says it is practicable for Mayor Ernesto Acain of this town to seek a compromise with electric provider TransCo that owed the town with business-site back taxes worth P 100 million from years 2000 to 2005.

This despite the garnishment filed by the mayor last year that stalled the P 76 million deposit of TransCo at the branch of Land Bank in Manila.

Baniqued explains that if the mayor –who is in his last term – has to exhaust all the legal remedies in a lengthy legal battle against the respondent, it would not be politically good under his watch.

“Remember my Digitel Case? Up to now I’m still trying to collect (the taxes it owed to the provincial government). I filed it sometimes in 1998 or 2000 that was in the previous (Governor Victor Agbayani) administration. The decision came out in the Supreme Court declaring the decision with finality on February 2007,” she narrates.

When she returned in 2008 as the legal officer under the Amado T. Espino administration nothing happened to the case she filed. Thus, she filed a Writ of Execution early of February 2009 at the Branch 69 of the Regional Trial Court in Lingayen to collect the proper amount from Digitel.

When asked that franchise holders like Digitel, National Power Corporation, and TransCo would stone-wall any monitorial claim against them just to avoid a Pandora Box of claims Baniqued opines that a legal victory against any one of them will be a precedent that would obliged anyone of them to pay similar claims in any parts of the country.
